Terms of Service

These terms govern your access to and use of Skyla Weather App, including the app, notifications, website, support channels, memberships, and related services.

These Terms of Service ("Terms") govern your access to and use of Skyla Weather App ("Skyla," "we," "us," or "our"), including our mobile application, notifications, website, support channels, memberships, and related services, collectively the "Service."

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Skyla provides weather information and weather-aware suggestions for convenience only. Do not rely on Skyla as your only source for severe weather, emergency, safety, travel, medical, or life-critical decisions.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian.

2. Weather Information and Alerts

Skyla may provide weather forecasts, current conditions, Smart Alerts, summaries, and weather-aware prompts. Weather data may come from third-party providers, public sources, device settings, and automated systems.

Weather information is inherently uncertain and may be incomplete, delayed, unavailable, inaccurate, or different from conditions in your exact location. Smart Alerts and notifications may fail to arrive, may arrive late, or may not reflect all relevant hazards.

You are responsible for checking official weather sources, emergency alerts, local authorities, and other reliable sources when weather or safety matters.

3. Calendar, Reminders, and Suggestions

If you grant Calendar or Reminders access, Skyla may provide weather-aware suggestions related to plans, commutes, outdoor meals, walks, travel, errands, or activities. These suggestions are for convenience only and are not professional, medical, transportation, safety, or emergency advice.

4. Accounts, Memberships, and Subscriptions

Some features may require a paid subscription, membership, purchase, entitlement, or other access right. Purchases and subscriptions made through Apple are handled by Apple and are subject to Apple's terms, billing rules, cancellation process, and refund policies.

Subscription features, prices, trials, renewal terms, and availability may change as permitted by applicable law and platform rules. You are responsible for managing or canceling subscriptions through your Apple account settings.

5. Acceptable Use

You agree not to:

  • Use the Service for unlawful, harmful, deceptive, or abusive purposes.
  • Interfere with, disrupt, reverse engineer, or attempt to gain unauthorized access to the Service.
  • Copy, scrape, resell, or commercially exploit the Service or its content except as permitted by us in writing.
  • Use automated systems to access the Service in a way that burdens or disrupts our systems.
  • Misrepresent your identity, permissions, location, or relationship with Skyla.
  • Use the Service to make life-critical or emergency decisions without checking official sources.

6. Intellectual Property

The Service, including its design, software, text, graphics, branding, features, and other content, is owned by Skyla or its licensors and is protected by intellectual property and other laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.

You may not use Skyla's name, logos, branding, or content in a way that suggests endorsement or affiliation without our prior written permission.

7. Third-Party Services

The Service may rely on or link to third-party services, including weather data providers, platform services, payment processors, analytics, diagnostics, hosting, notification delivery, or customer support tools. We are not responsible for third-party services, data, content, policies, performance, or availability.

8. Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect information in connection with the Service. By using Skyla, you also acknowledge our Privacy Policy.

9. Changes to the Service

We may modify, suspend, limit, or discontinue all or part of the Service at any time. We may also add, remove, or change features, content, eligibility, pricing, or availability, subject to applicable law and platform rules.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access to the Service if we believe you violated these Terms, created risk for Skyla or others, misused the Service, or if we discontinue the Service.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim warranties of accuracy, completeness, reliability, availability, merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that weather data, alerts, notifications, suggestions, membership features, or other parts of the Service will be accurate, timely, complete, uninterrupted, secure, or error-free.

12. Limitation of Liability

To the fullest extent permitted by law, Skyla and its owners, directors, employees, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, service interruption, device issues, personal injury, property damage, or other losses arising from or related to your use of or inability to use the Service.

To the fullest extent permitted by law, Skyla's total liability for any claim arising from or related to the Service or these Terms will not exceed the greater of the amount you paid to Skyla for the Service in the three months before the event giving rise to the claim or USD $50.

13. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Skyla and its owners, directors, employees, contractors, service providers, and licensors from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to your misuse of the Service, violation of these Terms, violation of law, or violation of another person's rights.

14. Apple App Store Terms

If you downloaded Skyla from the Apple App Store, Apple is not a party to these Terms and is not responsible for the Service or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as they relate to your use of the Service on Apple platforms. Your use of the Service must also comply with Apple's applicable App Store terms and rules, including the Standard Apple Terms of Use (EULA).

15. Governing Law and Disputes

These Terms are governed by the laws of Pennsylvania, United States, without regard to conflict of law rules. Subject to applicable law, you and Skyla agree that disputes arising from or related to these Terms or the Service will be resolved in the state or federal courts located in Pennsylvania, unless another dispute process is required by applicable law.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as by updating the effective date, posting a notice, or providing notice through the app where appropriate. Your continued use of the Service after an update means you accept the revised Terms.
